1. Acceptance of Terms
By accessing this website, purchasing, receiving, installing, or using any product offered by K9 TugTitan™ (collectively, the "Company," "we," "us," or "our"), you ("Customer," "User," or "You") acknowledge that you have read, understood, and agree to be legally bound by these Terms & Conditions, including the assumption of risk, waiver of liability, indemnification, arbitration, and class-action waiver provisions set forth below. If you do not agree, do not purchase or use our products.
2. Intended Use & Inherent Risk
K9 TugTitan™ products are heavy-duty industrial canine tug devices intended for use with healthy, trained, adult dogs under direct adult human supervision. Tug play with powerful breeds carries inherent risks including but not limited to: physical injury to the dog (joint, dental, muscular, ligament, neck or spinal injury), property damage, structural failure of anchor points, falls, lacerations from springs or hardware, and unpredictable animal behavior. You acknowledge and voluntarily assume all such risks.
3. Assumption of Risk & Waiver of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU EXPRESSLY AGREE THAT THE COMPANY, ITS OWNERS, OFFICERS, DIRECTORS, MEMBERS, SHAREHOLDERS, EMPLOYEES, AGENTS, CONTRACTORS, SUPPLIERS, AFFILIATES, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, "RELEASED PARTIES") SHALL HAVE ZERO LIABILITY FOR ANY INJURY, ILLNESS, DEATH, PROPERTY DAMAGE, LOSS, OR HARM OF ANY KIND — WHETHER TO YOU, YOUR DOG, ANY OTHER PERSON, ANY OTHER ANIMAL, OR ANY PROPERTY — ARISING OUT OF OR RELATED IN ANY WAY TO THE PURCHASE, POSSESSION, INSTALLATION, USE, MISUSE, OR FAILURE OF ANY K9 TUGTITAN™ PRODUCT. You hereby release, waive, discharge, and covenant not to sue the Released Parties for any and all claims, demands, actions, causes of action, damages, costs, or expenses (including attorneys' fees) arising from or in any way connected to the product.
4. Disclaimer of Warranties
ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. THE COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. No oral or written information or advice given by the Company shall create any warranty.
5. Limitation of Damages
UNDER NO CIRCUMSTANCES SHALL THE RELEASED PARTIES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY JURISDICTION WHERE LIABILITY CANNOT BE FULLY EXCLUDED, THE TOTAL AGGREGATE LIABILITY OF THE COMPANY FOR ANY AND ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.
6. Indemnification
You agree to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, judgments, awards, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your purchase, installation, or use of any product; (b) your breach of these Terms; (c) any injury or damage caused by your dog or property; or (d) your violation of any applicable law or third-party rights.
7. Installation & Supervision
You are solely responsible for safely anchoring the product to a structurally sound, properly rated mounting point and for inspecting all hardware, springs, fasteners, and anchor points before every use. Discontinue use immediately at the first sign of wear, deformation, corrosion, or fatigue. Never leave a dog unsupervised with the product. Children must not operate or be in proximity to the product during use.
9. Shipping, Handling & Returns
Shipping rates displayed at checkout include carrier costs and a non-itemized handling fee covering fulfillment, packaging, processing, and operational overhead. Handling fees are non-refundable. Returns of unused, undamaged products in original packaging may be accepted within 30 days; original shipping and handling are non-refundable and return shipping is the Customer's responsibility. Restocking fees may apply.
10. Pricing, Promotions & Discounts
All prices are in USD unless otherwise stated. Promotions including but not limited to "First 100 Customers" pricing, percentage discounts, and seasonal sales are limited, may end without notice, may not be combined with other offers, and are void where prohibited. The Company reserves the right to correct any pricing errors and to cancel any order at its sole discretion.
11. Governing Law, Arbitration & Class Action Waiver
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. Any dispute, controversy, or claim arising out of or relating to these Terms or any product shall be resolved exclusively by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. YOU WAIVE ANY RIGHT TO A JURY TRIAL AND ANY RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. If arbitration is held unenforceable, exclusive jurisdiction lies in the state and federal courts located in Delaware.
12. Severability & Entire Agreement
If any provision of these Terms is held invalid or unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall continue in full force and effect. These Terms constitute the entire agreement between you and the Company regarding the subject matter and supersede all prior agreements, communications, and understandings.
13. Changes to Terms
The Company may modify these Terms at any time. Continued use of the website or products following posting of revised Terms constitutes acceptance of the modifications.
